Heard learned counsel for the petitioner, learned Standing counsel appearing on behalf of the respondent no. 1 and Sri Kumar Ayush, learned counsel for the respondents no. 2 to 4. Sri Santosh Kr. Yadav Warsi, learned counsel for the petitioner after arguing at some length states that he would be willing to submit his reply to the notice dated 01.01.2025. He further states that he would be preferring the reply within ten days from today and prays that the competent authority who is said to be the Basic Shiksha Adhikari, Shravasti be directed to entertain the reply to the said show cause notice and decide the same on merits. To the aforesaid prayer, Sri Kumar Ayush, learned counsel for the respondents no. 2 to 4 has no objection. Accordingly, the writ petition is disposed of leaving it open to the petitioner to submit a reply to the Show Cause Notice within ten days from today. In case, the said reply is filed along with certified copy of this Court then the Basic Shiksha Adhikari, Shravasti shall consider the said reply on merits in accordance with law and relevant rules and pass an order upon the same within four weeks from the submission of the said reply along with certified copy of this order. As regards the payment of salary to the petitioner, it would be open for the petitioner to file a contempt application in accordance with law in case the order of the writ Court or any statement which has been given by the learned counsel appearing on behalf of the Basic Shiksha Adhikari has not been complied with.
