Neutral Citation No. - 2025:AHC-LKO:11848-DB Court No. - 1 Case :- WRIT - C No. - 1817 of 2025 Petitioner :- Kriparam Respondent :- State Of U.P. Thru. Its Prin. Secy. Social Welfare And 2 Others Counsel for Petitioner :- Brij Bhushan Singh,Bheem Singh,Himanshu Pathak,Pranjal Apurva,Sandeep Kumar Mishra Counsel for Respondent :- C.S.C.,Vinod Kumar Singh Hon'ble Attau Rahman Masoodi,J. Hon'ble Manish Kumar,J.
1. Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Vinod Kumar Singh
learned counsel who has put in appearance on behalf of the Bank.
2. Not only that the petitioner has committed a default in repayment of loan amount of Rs.30,000/- which has increased upto Rs.1,65,000/- lump-sum till 25.02.2025 but he has further sold the mortgaged property creating third party rights therein. The default in the present case appears to be irreparable and there does not seem to be a bonafide intention of the petitioner to repay the loan amount.
3. Learned counsel for the petitioner prays that he may be permitted to deposit the outstanding amount in the Bank in easy installments and the proceedings initiated against him may be kept in abeyance.
4. Learned counsel for the Bank does not have an objection provided the outstanding amount is deposited in installments without any further default.
5. Looking to the fact that the petitioner claims to be the agriculturist having no source of substantial income, we hereby provide that in case the petitioner deposits a sum of Rs. 60,000/- within a period of one month from today,
the residual amount shall be paid by him to the Bank in four quarterly installments.
6. Accordingly, the writ petition is disposed of with the following directions :- (i) The petitioner shall deposit Rs. 60,000/- within a period of one month from today. (ii) The Bank after accepting the said amount shall furnish the details of outstanding amount by providing him the statement of account. (iii) The amount so intimated to the petitioner by the Bank shall be deposited by the petitioner in four (4) equal quarterly installments, the first of which shall fall due last week of June, 2025 and the remaining installments shall be deposited as directed above. (iv) In case, the installments scheduled as per this order are paid, the proceedings initiated against the petitioner shall be kept in abeyance and ultimately dropped. (v) In case of default, it shall be open to the authorities of the bank to proceed against the petitioner in accordance with law. . (Manish Kumar,J) (Attau Rahman Masoodi,J)
