This is an intra court appeal under Clause 12 of the Letters Patent against an order dated November 28, 2025, vide which the petition (WP(C)/2941 of 2025) preferred by the appellant was disposed of by the Writ Court with a direction to the respondents to consider the petition itself as its representation and decide the same within a specified time:
“Having regard to the limited nature of controversy involved, the present petition is disposed of at its threshold with a direction to respondents to treat it as representation on behalf of the petitioner and decide the same as per law within a period of three weeks from the date copy of this order along with writ petition and annexures are made available to them.
Disposed of along with connected CM(s).”
At the outset, learned counsel for the respondents submit, for, the impugned order was passed on November 28, 2025 and pursuant thereto, the
Competent Authority, on consideration of the claim of the petitioner, has passed the necessary orders on December 13, 2025, rejecting its claim.
Faced with this, learned counsel for the appellant submits that nothing substantive survives in the present appeal and the same be disposed of as having been rendered infructuous. However, the appellant, if so advised, would assail the order dated December 13, 2025 in an appropriate proceedings.
Disposed of.
