Neutral Citation No. - 2025:AHC-LKO:12514-DB Court No. - 2 Case :- WRIT - C No. - 1864 of 2025 Petitioner :- M/S Singh Atta Chakki Thru. Proprietor Shaurabh Singh Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Energy Lko And 3 Others Counsel for Petitioner :- Bhuvan Dwivedi,Soumya Shukla Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. Contention of learned counsel for the petitioner is that the Demand Notice dated 09.01.2025 of electricity dues does not mention the period to which the demand is made, however,
learned counsel for the Electricity Corporation says that it is a case of electricity theft and he has in his possession the documents including the final assessment order which has been passed and the same is appealable. We have perused annexure No.6 and point no.3 of the said representation, wherein itself the petitioner has admitted to some proceedings under Section 135 of the Electricity Act, 2003 regarding electricity theft and dues of Rs.7,48,083/-, which are infact mentioned in the Demand Notice. In view of the aforesaid, we see no reason to interfere in the instant Writ Petition. The Writ Petition is accordingly dismissed with liberty to challenge the final assessment, if otherwise permissible under law, under Section 127 of the Electricity Act,
2003. (Om Prakash Shukla,J.) (Rajan Roy,J.)
