JUSTICE R.K. PATTANAIK Order No. ORDER 12.03.2025 01. 1. Heard Mr. Panda, learned counsel for the petitioner and Mr. Satapathy, learned ASC for the State. 2. Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with C.T. (N) Case No.41-B of 2020 corresponding to Gochhapada P.S. Case No.46 of 2020 pending in the file of learned Special Judge, Phulbani on the grounds stated therein. 3. Perused the F.I.R and the rejection order as at Annexures-1 and 3 respectively. 4. From the F.I.R. i.e. Annexure-1, the Court finds that the alleged recovery of contraband Ganja is from one Narottam Palia and he said to have disclosed the name of other accused persons. In fact, as per Annexure-4 series, two of the accused persons have been granted bail. The petitioner is one of the co-accused persons allegedly responsible for the illegal transportation of Ganja. But, considering such release of the co-accused persons as made to reveal from Annexures-2 series and 4 series and though, the petitioner is to face trial in a split up case as against whom NBWA is pending execution, the Court is of the view that he should be allowed to go on bail with conditions. 5. Accordingly, it is ordered. 6. In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with C.T. (N) Case No.41-B of 2020 arising out of Gochhapada P.S. Case No.46 of 2020 subject to him furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned Special Judge, Phulbani, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 7.
