(At Present Confined In District Jail Dholpur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Dushyant Jain, Adv. For Mr. Udit Sapra, Adv. For Respondent(s) : Mr. Sudesh Saini, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 26/03/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.29/2025, registered at Police Station Diholi, District Dholpur, for the offence(s) under Sections 420 and 406 of IPC. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the FIR itself is delayed by one year, no recovery of money was effected from the possession of the present petitioner. It is alleged against the accused-petitioner that they extorted 32 to 40 lakh rupees from the complainant on the pretext of providing employment in the year 2024. It is also contended that no such [2025:RJ-JP:13799] (2 of 2) [CRLMB-4066/2025] demand was made from the complainant and the complainant never paid any amount to the present petitioner, there is land dispute between the present petitioner and the complainant. There are no criminal antecedents against the accused-petitioner and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on the record. 5. Considering the impugned order dated 11.03.2025 and the fact that there are no criminal antecedents against the accused- petitioner, the alleged offences are exclusively triable by Magistrate, the accused-petitioner is in custody since 24.02.2025 and trial of the case may take considerable time, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Hariom Sharma S/o Shri Natthilal Sharma @ Kanhaiyalal, in connection with FIR No.29/2025, registered at Police Station Diholi, District Dholpur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
