The present writ petition has been filed by the petitioner with the following prayer :- "1. writ, order or direction in the nature of mandamus, commanding the opposite party nos. 2/ District Magistrate District Sultanpur to initiate preliminary enquiry against the Respondent no. 5 under Rule 4 of the U.P. Panchayat Raj (Removal of Gram Pradhan, U.P. Pradhan or members) Enquiry Rules 1997, on the basis of the complaints submitted by the petitioner in compliance of the Rule 3 of the Rules 1997 for misappropriation of the public fund allotted by government for development work of Village Panchayat under various schemes as MANREGA, Pradhan Mantri Avas Yojna etc., by abusing his position and also not discharging his duty in accordance with Rules." 3. Considering the fact that the said application is pending, the present petition is disposed of with direction to take action in pursuance of the application in accordance with law preferably within a period of three months.
