(Oral) Since representation having been filed by the petitioner, praying therein for his transfer from Tehsil Office Kamrou, District Sirmaur, Himachal Pradesh, to one of the stations of his choice, is not being considered by the competent authority, he is compelled to approach this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his representation in a time bound manner.
2. It has been averred in the petition that petitioner has already completed normal tenure of posting at present place of posting and as such, he can be transferred from afore station to DC Office Sirmaur at Nahan, where as many as 15 posts of JAO (IT) are lying vacant.

Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. Mr. Chauhan, fairly states that representation (Annexure P-1) filed by the petitioner, if not already decided, shall be decided expeditiously.

It also emerge from the pleadings that case of the petitioner has been recommended by the Deputy Commissioner, Sirmaur at Nahan to Divisional Commissioner, Shimla Division, Shimla, Himachal Pradesh, vide communication dated 23.02.2024 (Annexure P-1), but till date no action has been taken upon the same.

Consequently, in view of above, present petition is disposed of with a direction to Divisional Commissioner, Shimla to take appropriate action upon the recommendation made by Deputy Commissioner vide communication dated 23.02.2024, expeditiously, if not already taken, preferably within a period of two weeks. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders.
