Through this petition, the petitioner has prayed for the following relief:- "1. Issue order or direction to Judicial Magistrate Kunda, Pratapgarh to expedite disposal of complainant case no. 03/24 under section 138 N.I.Act old no.06/013 (Chandra Kishor vs. Manoj Kumar) pending before his court for adjudication. II. Issue any other order or direction in the favor of the petitioner on the basis of said circumstances which this is Hon'ble Court may deem fit and proper." Learned counsel for the petitioner submits that complaint case under Section 138 NI Act was filed in the year 2013. Statement of the complainant under section 200 Cr.P.C and the statement of the witnesses under section 202 Cr.P.C were taken and thereafter cognizance was taken on 12.6.2023. Summons were issued to respondent no.2 for appearance. Respondent no.2 has not cooperated in the trial. He submits that till date trial has not commenced. Considering the above, the application is disposed of directing the learned trial court to expedite the complaint in view of the provisions under Section 143 N.I.Act and make an endeavour to decide it within six months.
