(2) Petitioner’s mother was employed as Lecturer (Mathematics) in a government aided intermediate college, namely, Arya Kanya Inter College, Kotdwar, District Pauri Garhwal, who died on 23.5.2024. Petitioner has applied for compassionate appointment. Decision on his application, however, has not been taken so far, therefore petitioner has filed this writ petition seeking a direction to Chief Education Officer, Pauri to take decision on his application. (3) Learned Counsel for the petitioner submits that Regulation 93 of Regulations framed under Uttarakhand School Education Act provides for compassionate appointment in government aided schools. He thus submits that delay on the part of the competent authority in taking decision in the matter is unjust. (4) Learned State Counsel, by referring to Annexure-3 to the writ petition, submits that the Management of the concerned school has not forwarded the application made by petitioner for compassionate appointment. (5) Writ petition is, accordingly, disposed of with a direction to Chief Education Officer, Pauri to consider the application made by petitioner seeking 2025:UHC:9303 compassionate appointment and pass appropriate order, as per law, within eight weeks from the date of presentation of certified copy of this order. It shall be open for the Chief Education Officer to summon the application made by petitioner from the Committee of Management.
