Criminal Miscellaneous Bail Application No.4155/2025 Rajpal S/o Ratiram, R/o Tihli Police Station Tijara District Khairthal Tijara. At Present In Sub Jail, Kishangarhbas. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Harendra Singh, Adv. For Respondent(s) : Mr. Sudesh Saini, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 27/03/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.329/2024, registered at Police Station Tijara, District Bhiwadi, for the offence(s) under Sections 147, 148, 149, 323, 341 and 307 of IPC.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that though the name of the accused-petitioner appeared in the FIR but the material eye-witnesses i.e. injured Smt. Anita wife of Hansraj, Saroj, Ramrati, Rajendra and Hansraj in their statements have not named the present accused-petitioner in causing the injuries to them. It is also contended that in the photographs captured from the complainant Chandrapal, the accused-petitioner has not been shown as co-accused. The other persons have been
[2025:RJ-JP:14132] (2 of 3) [CRLMB-4155/2025] shown in these photographs. Similarly, videos were also recovered from the complainant Chandrapal. In these videos also the presence of the accused-petitioner has not been shown. The accused-petitioner is in custody since 24.02.2025 and trial of the case may take considerable time, therefore, considering the above
facts, the bail application of the accused-petitioner may be dismissed.
3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that in the FIR and in the statements of all the injured witnesses, the name of the accused- petitioner has been mentioned and the accused-petitioner alongwith the other co-accused assaulted the complainant-party and caused injuries to Rajendra, Ajay, Hansraj, Anita, Saroj, Rewati and as result of the attack the grievous injuries caused to the injured, therefore, considering the above facts, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on the record.
5. In the statement of all the injured witnesses have attributed injuries caused to them to the other co-accused and not to the present accused-petitioner. In the photographs and videos recovered from the complainant Chandrapal, the present petitioner’s presence was not found, therefore, considering the above facts, it is not desirable to express anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail.
6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Rajpal S/o Ratiram, in connection with FIR No.329/2024,
[2025:RJ-JP:14132] (3 of 3) [CRLMB-4155/2025] registered at Police Station Tijara, District Bhiwadi, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
