Neutral Citation No. - 2025:AHC-LKO:10823 Court No. - 16 Case :- APPLICATION U/S 482 No. - 1575 of 2025 Applicant :- Shankar Lal Opposite Party :- State Of U.P. Thru. A.C.S./Prin. Secy. Deptt. Of Home U.P. Lko. And 4 Others Counsel for Applicant :- Manuvendra Singh Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner as well as learned AGA for the State. Notices to respondent no. 2 to 5 are dispensed with in view of the proposed order. This petition has been filed against the impugned order dated 01.07.2023 whereby the application filed by the petitioner under Section 156(3) Cr.P.C. was rejected as well as order dated 16.11.2024 whereby the Revisional Court affirmed the order dated 01.07.2023. Perused the record. A perusal of the impugned order shows that the dispute primarily between the parties is of ownership of land bearing Gata Nos. 531 and 533. The Additional District Magistrate Pratapgarh vide order dated 13.01.2023 substituted the names of respondent no. 2 to 5 in place of the petitioners on the basis of will. Aggrieved by this order, an appeal bearing appeal No. 664/2023 was filed by the petitioner which was allowed vide order dated 16.11.2023. Subsequently, a revision petition against this order has been filed which is pending before the Board of Revenue. Prima facie the dispute appears to be civil in nature. There appears to be no good ground to interfere in the matter. The petition is devoid of merits and is accordingly dismissed. Order Date :- 19.2.2025/R.C.
