Heard Mr. W. Shantikumar, learned counsel for the petitioners, Mr. BR Sharma, learned CGC assisted by Ms. Kamei Landumshinlu, learned counsel for the respondent no. 1 (Union of India), Ms. Ksh. Harichhaya, learned counsel for the respondent nos. 2 to 6 (NHPC) and none appears on behalf of the respondent no. 7. [2]
By the present writ petition, the petitioners who are earlier Work charged employees of Electrical Circle, Loktak Hydro Electric Project, Manipur, NHPCL approached this Court claiming for 9 (nine) months due of the remuneration and also praying for balance amount as mentioned in i) order dated 06.12.2006 passed by the Central Government Industrial Tribunal-Cum-Labour Court, Gauhati, Assam, in Ref. Case No. 4 of 2014, ii) order dated 22.06.2010 passed by the Learned Single Judge of Gauhati High Court in W.P. (C) No. 1834 of 2007 and iii) order dated 28.07.2011 passed by the Division Bench of Gauhati High Court in W.A. No. 160 of 2011. [3]
On perusal of the writ petitions, the period and amount claim for as due of the remuneration before placement has not been properly explained and mentioned, besides the 3(three) orders relied by the petitioners held that nothing is due to the workmen. In the circumstances, the present writ petitions are dismissed as withdrawn with liberty to file a fresh one, if so advised. [5]
It is made clear that this Court doesn’t express any opinion on the merit of the case. [6]
With these observations, the present W.P. (C) No. 1028 of 2015 and W.P. (C) No. 1029 of 2015 are disposed of.
