Neutral Citation No. - 2025:AHC-LKO:12169-DB Court No. - 2 Case :- WRIT - C No. - 1713 of 2025 Petitioner :- Vivek Kesarwani Respondent :- Union Of India Thru. Joint Secy. Enemy Property Home Ministry New Delhi And 2 Others Counsel for Petitioner :- Gargi Prakash Misra,Sunita Srivastava Counsel for Respondent :- A.S.G.I. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard.
2. We asked learned counsel for the petitioner as to whether the petitioner-Vivek Kesarwani was asserting his own rights or that of some other person whereupon Sri Gargi Prakash Mishra,
learned counsel for the petitioner fairly submitted that it is the rights of Starling Agro Industries Limited which are being asserted in the writ petition and Sri Vivek Kesarwani is its authorized representative. Apparently, even if Sri Vivek Kesarwani is the authorized representative of Starling Agro Industries Limited it is the latter company which should have been made the petitioner and not Sri Vivek Kesarwani who may file it on behalf of the company as its authorized representative. Petition in its present format is not acceptable.
3. Accordingly, the petition is dismissed with liberty to the aforesaid Starling Agro Industries Limited to prefer a writ petition in its own name if there is a cause. (Om Prakash Shukla,J.) (Rajan Roy,J.)
