Jayant Kumar Vs. Harbans Singh Cr. Revision No. 213 of 2025 4.8.2025 Present: Ms. Kanta Thakur, Advocate, for the petitioner. Ms. Tim Saran, Advocate, for the respondent. Parties are present in person. Report has been received from the learned Mediator, wherein it has been mentioned that both the parties have settled the matter. As per the settlement, the entire amount has been paid to the complainant-Harbans Singh. It has been submitted that 20% of the compensation amount i.e. ₹46,000/- have been deposited before the learned Trial Court and as per the compromise effected between the parties, the amount is to be released in favour of the complainant. The complainant has further stated that in view of the compromise, he does not want to proceed further with the complaint. In view thereof, the judgment dated 5.4.2025, passed by learned Sessions Judge, Solan in Criminal Appeal No. 24-S/10 of 2022 (Registration No. 52 of 2022), titled Jayant Kumar Vs. Harbans Singh, affirming the judgment of conviction dated 2.4.2022, passed by learned Trial Court passed in Criminal Complaint No. 15-3 of 2014/11
(Registration No. 444 of 2015) and order of sentence dated 29.4.2022, are ordered to be set-aside. The complaint is dismissed as not pressed, so also the pending miscellaneous application(s), if any. Since the matter has been compromised between the parties before the learned Mediator, therefore, the requirement of depositing 15% of the cheque amount has been dispensed with. (Rakesh Kainthla)
