ORDER 25-02-2025
1. The petitioner No. 1 is the husband of the respondent No. 1 and the father of the respondents No. 2 to 4 who are minor children. The petitioners No. 2 and 3 are parents of the petitioner No.1.
2. The petitioners are aggrieved of initiation of proceedings at the instance of the respondent No.1 under the Protection of Women from Domestic Violence Act, 2005 before the Court of Chief Judicial Magistrate, Handwara on file No.148/M on the plea that a mutual settlement had brought the matrimonial estrangement between the petitioner No. 1 and the respondent No. 1 to an amicable end and there was no occasion for the respondent No. 1 to have gone for the proceedings under the Protection of Women from Domestic Violence Act, 2005 except for the purpose of
subjecting the petitioner No. 1 in particular to harassment. The petitioner No. 1 is reported to be in Armed Forces.
3. This Court is inclined to show indulgence in the matter subject to the petitioner No. 1 depositing litigation expenses of Rs 25000/- with the Registrar Judicial of this Court within a period of ten days upon deposit of which notice to go to the respondent No. 1 only for appearance in the case be personal or through counsel, as the case may be.
4. The respondent No. 1 shall be entitled to seek withdrawal of deposited litigation expenses of Rs. 25000/- from the Registrar Judicial of this Court.
5. In the event of default of deposit of Rs. 25000/- within the time given, the petition shall suffer dismissal for non-compliance without reference to the Bench.
6. List on 26th March, 2025.
7. Upon deposit of the amount of Rs. 25000/- as ordered above, the proceedings in the matter before the Court below shall come to stay.
