Baishya, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 430 (1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for suspension of sentence imposed upon the applicant Md. Rashidul Islam by the learned Special Judge, Assam, Guwahati in Special Case No.10/2020. 3. I have considered the submissions made by learned counsel for both the sides. 4. The applicant was sentenced to undergo 18 months of rigorous imprisonment for the offence under Section 224 of the Indian Penal Code. Since he was sentenced to undergo a fixed period of imprisonment, the prayer is allowed. 5. Therefore, the sentence imposed upon the applicant Md. Rashidul Islam in Special Case No.10/2020 by the learned Special Judge, Assam, Guwahati shall remain suspended till disposal of the connected appeal. 6. The applicant Md.
