1 / 3 2025:CGHC:13849 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 1700 of 2025 1 - Dr. Sunil Kumar Xess S/o Nicolus Xess, Aged About 50 Years Working As Medical Officer, And Posted At Govt. Community Health Centre Kansabel, District Jashpur (C.G.) ... Petitioner versus 1 - State Of Chhattisgarh Through The Secretary, Department Of Health And Family Welfare, Mantralaya, Mahanadi Bhawan, Atal Nagar, Naya Raipur, District Raipur (C.G.) 2 - Chief Medical And Health Officer, Jashpur, District Jashpur (C.G.) 3 - Dr. Arun Kumar Bambeshwar, Medical And Health Officer, Posted At Community Health Centre Kansabel, District Jashpur (C.G.) ... Respondents (Cause title is taken from Case Information System) For Petitioner : Mr. Ravipal Maheshwari , Advocate For Respondents/ State : Ms. Poorva Tiwari, Panel Lawyer (HON’BLE SHRI JUSTICE BIBHU DATTA GURU) Order on Board 22/03/2025 1. By the present writ petition, the petitioner, who is working on the post of Medical Officer at Community Health Centre, Kansabel, 2 / 3 District Jashpur, is questioning the transfer order dated 14/08/2024 (Annexure P/2) passed by respondent No.1 whereby the petitioner has been transferred from the present place of posting to Primary Health Centre, Piparchhedi, District Balod. 2. Learned counsel appearing for the petitioner submits that earlier the petitioner has filed a writ petition bearing WPS No.6110/2024 by questioning the same transfer order and the said writ petition was decided vide order dated 30/09/2024 with a direction to the respondent authorities to consider the representation submitted by the petitioner within a period of four weeks, however, as the counsel for the petitioner submits that the representation filed by the petitioner has not been decided till date, hence, he has filed the present writ petition raising the same grievance as he has raised in the previous writ petition. 3. Per contra, Learned counsel appearing for the State would submit that once the transfer order has been challenged in a writ petition bearing WPS No.6110/2024 and the same has been decided vide order dated 30/09/2024, the present writ petition is not maintainable challenging the same transfer order. 4. I have heard learned counsel for the parties and perused the documents. 5. In view of the rival submissions made by learned counsel for the parties and particularly considering the fact that the petitioner has already challenged the transfer order dated 14/08/2024 in a writ petition bearing WPS No.6110/2024 and the same has been 3 / 3 decided by the Coordinate Bench of this Court vide order dated 30/09/2024 directing the petitioner to submit a representation and the same was directed to be decided by the respondent authorities, within a period of 4 weeks, the present writ petition filed by the petitioner on that same ground as he has raised the same grievance in the previous writ petition, is not maintainable. 6. Accordingly, the instant Writ Petition is dismissed with a cost of Rs.2,000/- payable to the High Court Legal Aid Services Committee. Sd/- (BIBHU DATTA GURU) JUDGE $. Bhilwar
