Lko And 3 Others Counsel for Petitioner :- I.M. Pandey Ist,Ajeet Verma Counsel for Respondent :- C.S.C.,Santosh Kr. Yadav Warsi Hon'ble Abdul Moin,J. 1. Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondents No.1 and 2 and Sri Santosh Kumar Yadav Warsi, learned counsel appearing for respondents No.3 and 4. 2. With the consent of learned counsel for the parties, the instant writ petition is being finally decided. 3. The contention of the learned counsel for the petitioner is that, despite the petitioner working as an Accompanist Tabla Instrumentalist since the year 1989 and being fully eligible for promotion to the post of Junior Lecturer (Tabla) as per Rule 4(1) of the Bhatkhande Sangeet Sansthan Adhinasth Shiksha Seva Niyamavali, 2013, the competent authority has failed to consider the claim of the petitioner for promotion, and hence this petition. 4. After arguing at some length, learned counsel for the petitioner submits that with regard to the relief sought in the writ petition, the petitioner may be permitted to submit a representation before the respondent No.3 which may be directed to be decided within a fixed time frame to which learned Standing Counsel appearing for respondents No.1 and 2 and Sri Santosh Kumar Yadav Warsi, learned counsel appearing for respondents No.3 and 4 have no objection. 5. In view of the above, it is provided that in case the petitioner submits a representation within four weeks from today before the respondent No.3 then the respondent No.3 shall endevour to decide the same by means of a reasoned and speaking order within a further period of six weeks from the date of receipt of a certified copy of this order along with representation. 6. With the aforesaid direction, writ petition is disposed of. 7. It is made clear that this Court has not gone into the merits of the case.
