Neutral Citation No. - 2025:AHC-LKO:10543-DB Court No. - 2 Case :- WRIT - C No. - 1657 of 2025 Petitioner :- Anwar Husain @ Anwar Khan Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko And 6 Others Counsel for Petitioner :- Piyush Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. The contention of the petitioner is that although there is an order of status quo operating in the proceedings under Section 116 of the U.P. Revenue Code, 2006 passed by the opposite party No.4, Sub Divisional Magistrate, Tehsil Utraula, District- Balrampur but the opposite party No. 6 and 7 are violating the same by undertaking construction of a house. It is informed that opposite party No.6 is defendant in the said suit and opposite party No.7 is the son of opposite party No.6. 3. Without prejudice to the rights of the opposite party No.6 and 7 in the pending proceedings, if it is so, let the opposite party No.4 and 5 get the facts verified based on the spot inspection/inquiry to ascertain as to whether the status quo order has been violated by the opposite party No.6 and 7, if so, to do the needful as per law i.e. if the status quo order is still operating. Let such action/decision be taken within a period of three weeks on receipt of a certified copy of this order. It would be better if the Sub Divisional Magistrate concerned disposes of the proceedings under Section 116 of the U.P. Revenue Code, 2006 itself at the earliest say within a period of three months so as to avoid such situations. 4. With the aforesaid observations/directions, the writ petition is disposed of.
