Anjali Devi And Another Counsel for Revisionist :- Sanjai Kumar Singh,Piyush Trivedi Hon'ble Karunesh Singh Pawar,J. 1.Heard learned counsel for the revisionist and perused the record. Notice to private respondents is dispensed with in view of the proposed order. 2.Present revision is preferred with prayer to set aside order dated 1.1.2025 and order dated 6.9.2024 passed by Addl. Principal Judge, Family Curt, Court No.1, district Unnao in Crl. Misc. Case No.866 of 2021 Smt. Anjali Devi and another versus Virendra Yadav under section 125 CrPC, by which each of respondents have been granted maintenance of Rs.2,500/-. 3.A perusal of the record shows that it is not disputed that respondent No.1 is legally wedded wife of the revisionist and respondent No.2 is his minor daughter. The respondents are destitute and are unable to maintain themselves. Respondent No.1 was subjected to demand of dowry, cruelty and was ousted from the house of the revisionist, and is presently residing with her parents. On the other hand, revisionist is a healthy person. Although respondent No.1 has stated that financial condition of the revisionist is good and he works in Mumbai at a grocery shop, however, the revisionist in spite of coming to court has not filed any written statement nor has filed any evidence to rebut the evidence given by respondent No.1. The revisionist is capable of maintaining himself and his wife as also his minor child. Considering all aspects of the matter, the learned Family Court has awarded maintenance of Rs.2,500/- to each of the respondents. 4.I find no illegality in the order impugned. 5.The revision lacks merit and is accordingly dismissed.
