It has been brought to our notice by learned counsel appearing for the respondents that, during the pendency of the present appeal and subsequent to the rejection of the appellant's bail application, the learned Trial Court has recorded the statements of four additional prosecution witnesses. It is submitted that, with the recording of the aforesaid evidence, the Trial Court has sofar recorded the statements of 14 out of total 19 prosecution witnesses. 02. In these circumstances, we are of the considered opinion that the Trial Court would now be in a better position to appreciate whether an evidence against the petitioner has come on record or that whether the petitioner in the wake of the evidence on record is entitled to bail or not. 03. For the foregoing reasons, we are of the considered opinion that this appeal deserves to be disposed of with a direction to the Trial Court to reconsider the bail plea of the petitioner in the light of statements of fourteen prosecution witnesses recorded so far and pass appropriate order within a MIR ARIF MANZOOR I attest to the accuracy and authenticity of this document 24.07.26 period of one month from the date a copy of this is received by the Trial Court.
