Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Kuchai P.S. Case No.21 of 2023 corresponding to G.R. Case No. 522 of 2024(S) (Sessions Trial No. 36 of 2025) initially registered for the offences punishable under sections 380/34 of the Indian Penal Code and subsequently Section 395 of the Indian Penal Code has been inserted vide order dated 19.12.2023.
The learned counsel for the petitioners files a supplementary affidavit. Keep the same in the record.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with the co-accused persons committed dacoity and looted cash of Rs.1,50,000/-, cheque book, pass book and other documents. It is further submitted that the allegations against the petitioner are all false and the petitioner is not named in the F.I.R. It is then submitted that the petitioner has been implicated in this case only on the basis of statement of the co-accused –Kali Charan Marla and other co-accused persons. It is next submitted that the petitioner has been in custody since 11.09.2024, as has been mentioned in paragraph no. 12 of the bail application. It is then submitted that without putting the petitioner on Test Identification Parade, charge
sheet has been submitted against him. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the co-accused person has already been admitted to bail by a Co-ordinate Bench of this Court vide
order dated 27.11.2024, in B.A. No. 9792 of 2024. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Seraikella, in connection with Kuchai P.S. Case No.21 of 2023 corresponding to G.R. Case No. 522 of 2024(S) (Sessions Trial No. 36 of 2025) with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
