Following
order passed in the matter on 30.05.2025, notices the gist of petitioner’s case:-
“Notice. Mr. Y.P.S.Dhaulta, Additional Advocate General, appears and waives service of notice on behalf of the respondents. Petitioner’s grievance is that despite order having been passed in his favour on 04.12.2023 by the Controlling Authority under the Payment of Gratuity Act, 1972 (Labour Officer), Bilaspur Zone, for paying him the gratuity of Rs. 4,62,246/- alongwith simple interest @ 9% w.e.f. 04.01.2024 and despite Recovery Certificate dated 16.01.2025, having been issued by the said Authority under Section 8 of the Payment of Gratuity Act, 1972 (Act in short) the said amount alongwith interest has not been released in his favour. Let learned Additional Advocate General to have instruction in the matter and also to ensure that due and admissible gratuity to the petitioner as per order passed by the Controlling Authority under the Payment Gratuity Act, 1972 (Labour Officer) Bilaspur Zone is paid to the petitioner. List on 27.06.2025.”

Pursuant thereto, learned Additional Advocate General has placed on record a copy of the office instructions dated 31.07.2025 issued by the Executive Engineer, Jal Shakti Division, Jhandutta, in terms of which the State Finance Department has sanctioned an amount of Rs.5,11,847/- as the charged amount; Accordingly, sanction was granted by the concerned office on 28.07.2025; Based thereupon, bills have been prepared to clear the outstanding dues towards the petitioner, comprising the principal amount of Rs.4,62,246/- and interest amount of Rs.49,601/-; The same have been submitted to the Treasury Officer, Jhandutta, on 29.07.2025 for further necessary action. The office instructions are also supported by the relevant documents.

Since the respondents have now directed the concerned Treasury Officer, Jhandutta, to release the amount due to the petitioner by forwarding the bills in this regard, the present writ petition stands disposed of as the petitioner’s grievance has been redressed. However, the petitioner shall be at liberty to seek appropriate remedy in accordance with law for redressal of any surviving grievance(s), if any, in case necessity so arises in future.
