[2025:RJ-JP:30314-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Civil Contempt Petition No. 281/2025 in D.B. Civil Writ (P.I.L.) Petition No.14328/2024 Subhash Kumar Son Of Baldev Singh, Aged About 43 Years, Resident Of Village Kudli Tehsil And District-Sikar (Rajasthan). ----Petitioner Versus
1. The State Of Rajasthan, Through Additional Chief Secretary, Rural Development And Panchayati Raj Department, Government Secretariat, Jaipur (Rajasthan)
2. Shri Yogesh Arya, Tehsildar Sikar (Rajasthan), Office At Urban Improvement Trust Sikar (Rajasthan) ----Respondents For Petitioner(s) : Mr. Amit Singh Shekhawat, Adv. For Respondent(s) : Mr. G.S. Gill, AAG assisted by Ms. Shikha Sharma, Adv. Mr. Mukul Sharma, Collector, Distt. Sikar HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE SANJEET PUROHIT
Order 06/08/2025
1. Mr. Mukul Sharma, Collector, Distt. Sikar, is present in the Court today and stated that the order passed by this Court way-back on 12.09.2024, has been complied with today to the extent of demarcation of the land. Further compliance of the said
order regarding encroachments shall be looked into by the District Collector, who will see to it that the compliance has been made by the concerned Urban Improvement Trust (U.I.T.).
2. We have also noticed that the orders passed by this Court time and again, are not being complied with and contempt proceedings have to be initiated for getting the orders complied. It is not a happy situation at all. If the Senior officers find that their
[2025:RJ-JP:30314-DB] (2 of 2) [CCP-281/2025] subordinate officers, who are also parties to the proceedings, are not complying with the Court’s order(s), then adequate action and accountability should be put on such officers.
3. In the present case too, we find that it was the Tehsildar concerned, who was required to take steps. However, in spite of specific and clear direction to him, the compliance was not done and we had to forcefully call the District Collector before us. It would do well to the Collector to take appropriate action and a compliance report in this regard shall be filed by his Office to this Court. His personal appearance before this Court for future, is exempted.
4. The contempt proceedings are closed but the file shall be placed before us on 09.09.2025 only for the purpose of compliance.
5. The present contempt petition stands disposed of.
6. Notice(s), if any, also stands discharged.
