The petitioners allege a move by the opposite parties to construct a police chowki over their bhumidhari land bearing Gata No.650 situated at Village Puraini, Tehsil Kaisarganj, Pargana-Hisampur, Police Station-Huzurpur, District-Bahraich, however, the Brief Holder has instructions to the effect that a police chowki is being constructed on adjacent land which is recorded as Banjar and bears Gata No.651. The petitioners may get their bhumidhari land demarcated under Section 24 of the U.P. Revenue Code, 2006. If as a result of such demarcation, it is found that the police chowki has been constructed on petitioners' land then the opposite parties will either have to remove the construction or pay adequate compensation to the petitioners as per law. The petitioners may take remedial measures in this regard based on the result of the demarcation. It is made clear that the opposite parties should not undertake construction of any police chowki on any part of Gata No.650, if it is bhumidhari land of the petitioners unless it is acquired or purchased. 3. With the aforesaid observations/directions, the writ petition is disposed of. 4. Copy of this order be sent to the Superintendent of Police, District-Bahraich by Shri Raghvendra Kumar Singh, Brief Holder for the State-authorities.
