Neutral Citation No. - 2025:AHC-LKO:10761 Court No. - 16 Case :- CRIMINAL REVISION No. - 214 of 2025 Revisionist :- Satish Jaiswal Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Revisionist :- Prashant Sharma,Sanjay Kumar Verma Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the revisionist and learned A.G.A., Shri Anshuman Verma, for the respondent State. Notice to respondent no.2 is dispensed with in view of the proposed order. Present criminal revision has been filed by the revisionist Satish Jaiswal against the impugned order 28.11.2024 passed by the Additional Principal Judge, Family Court, Room No.6, Lucknow in Criminal Case No.1085 of 2013 under Section 125 Cr.P.C., District Lucknow. Perusal of the record shows that the revisionist has made partial payment of interim maintenance. Respondent no.2 is the legally wedded wife of the revisionist. She is residing away for sufficient cause. Presently she has no source of income. She is physically not healthy to earn her livelihood. On the other hand, the revisionist is capable of maintaining her. Nothing has been brought on record by the revisionist to show that the provisions of sub-section 4 of Section 125 Cr.P.C. are attracted. A meager amount of maintenance has been directed by the learned court below. No interference is warranted. The order impugned suffers from no illegality. The revision, being devoid of merit, is accordingly dismissed. Order Date :- 19.2.2025 Madhu D.R/P.S Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
