Petitioners were initially engaged on daily wages in Lake Development Authority, Nainital (now known as District Level Development Authority, Nainital) between 1997 to 2002. Their services were subsequently regularised on 21.03.2015. 5. According to the petitioners, in some other Development Authority, similarly situate employees were regularised from the date they were engaged on daily wages and all service benefits were also given to them. 6. By means of this writ petition, petitioners have sought the following relief:- “I. Issue a writ order or direction in the nature of mandamus directing and commanding the respondents to grant all service benefits including pay protection, fixation of salary, ACP and seniority from the date of initial joining in service with consequential benefits i.e. pay the differences of arrear of salary to the petitioners expeditiously as possible as earlier.” 2025:UHC:8372 7. Learned counsel appearing for the District Level Development Authority submits that since petitioners have made representation on 26.12.2023, therefore, the competent authority shall take decision on the representation within stipulated time frame. 8. Learned counsel for the petitioners submits that petitioners be permitted to make fresh representation. 9. The writ petition is, accordingly, disposed of by permitting the petitioner to make separate representations afresh to the Secretary, District Level Development Authority, Nainital seeking monetary benefits from the date of their initial appointment. If petitioners make such representations within two weeks from today, the same shall be placed before the competent authority, who shall take decision thereupon, as per law, within four months thereafter.
