This writ petition was filed seeking directions to the respondents to convene the meeting of Departmental Promotion Committee (DPC) for promotion to the post of Deputy Director, so that the petitioner also gets promoted to the aforesaid post.

Learned Senior Counsel for the petitioner submits that during the pendency of the writ petition, the

respondents have convened the meeting of DPC. On the basis of its recommendations, respondents No.5 and 6 have been promoted to the post of Deputy Director at Planning Headquarters, Shimla against vacant posts vide notification dated 06.02.2025. That in terms of the said notification, promotion of respondents No.5 and 6 has been made subject to final outcome of the instant writ petition, i.e. CWP No.3970 of 2023. Learned Senior Counsel further submits that the petitioner has instituted a separate writ petition, bearing CWP No.8997 of 2025, against the promotions given to respondents No.5 and 6 vide notification dated 06.02.2025. Vide order dated 30.05.2025 passed in CWP No.8997 of 2025, promotions of present respondents No.5 and 6 have been made subject to final outcome of that writ petition.

In view of above, learned Senior Counsel for the petitioner submitted that the instant writ petition be
disposed of with direction to the respondents to make the promotions given to present respondents No.5 and 6 to the post of Deputy Director at Planning Headquarters, Shimla vide notification dated 06.02.2025, subject to final outcome of CWP No.8997 of 2025 instead of CWP No.3970 of 2023.

Learned counsel appearing for the respondents including learned Additional Advocate General have no objection to the aforesaid innocuous prayer made for the petitioner.

Hence, this writ petition is disposed of with the
order that promotions of respondents No.5 and 6 to the post of Deputy Director at Planning Headquarters, Shimla, given to them under notification dated 06.02.2025, shall be subject to final outcome of CWP No.8997 of 2025. If considered necessary, appropriate notification/ corrigendum regarding promotion of respondents No.5 and 6 to the aforesaid post be issued afresh by the respondent- State.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
