Neutral Citation No. - 2025:AHC-LKO:13102 Court No. - 5 Case :- WRIT - A No. - 2148 of 2025 Petitioner :- Km. Kalpana Respondent :- State Of U.P. Thru. Prin. Secy. Basic Education Lko. And 3 Others Counsel for Petitioner :- Pradeep Kumar Verma,Devendra Bahadur Yadav Counsel for Respondent :- C.S.C.,Net Ram,Ran Vijay Singh Hon'ble Abdul Moin,J. Heard. The petitioner has challenged the transfer order dated 30.12.2024, a copy of which is annexure 12 to the writ petition, whereby the petitioner has been transferred from one block to other. The order impugned dated 30.12.2024 is in two parts namely it imposes major penalty against the petitioner and transfers the petitioner from one block to the other. The petitioner has only challenged the part of the order by which he has been transferred. The perusal of the order indicates that reference to a government order dated 08.08.2022 has been given which government order is produced today before this Court by learned counsel for the petitioner. The Court being a court of record, takes the government order on record. Perusal of the said government order would indicate that it only indicates that the government order is passed in a pursuance to a particular special appeal namely Special Appeal No. 274 of 2020 and has got nothing with the case of the petitioner. Upon the same being pointed out Shri Ran Vijay Singh, learned counsel for the respondents submits that the respondents may be directed to revisit the order impugned so far as it pertains to transfer of the petitioner. Considering he aforesaid, the writ petition is allowed. The order dated 30.12.2024, a copy of which is annexure 12 to the writ petition, so far as it transfers the petitioner from one block to the other, is quashed. The respondents would pass a fresh order of transfer, if required, in accordance with law and relevant rules. Let such an order be passed within two weeks from the date of receipt of certified copy of this order. Order Date :- 4.3.2025 J. K.
