Neutral Citation No. - 2025:AHC-LKO:10641
Court No. - 16 Case :- CRIMINAL REVISION DEFECTIVE No. - 82 of 2025 Revisionist :- Dharmanand Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko And 2 Others Counsel for Revisionist :- Rajesh Kumar,Suhail Kashif Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. (Application No.1 of 2025) Heard learned counsel for the revisionist and gone through the pleadings made in the affidavit filed in support of the application. Cause shown seems to be sufficient and thus, the application is allowed.
ORDER ON MAIN REVISION Heard learned counsel for the revisionist and perused the record. Notice to respondent Nos.2 and 3 is dispensed with in view of the proposed order. From perusal of the record, it is evident that respondents 2 and 3 are destitute and incapable to maintain themselves. They are residing away from the revisionist for sufficient cause. The revisionist has neglected to maintain them. The revisionist is a healthy person and has adequate source of income to maintain himself as well as respondents 2 and 3. The respondents 2 and 3 are entitled to receive maintenance from the revisionist. Considering these aspects, the impugned order has been passed directing the revisionist to pay maintenance to the private respondents. There appears to be no illegality in the order impugned. The revision, being devoid of merit, is dismissed.
