Neutral Citation No. - 2025:AHC-LKO:11501 Court No. - 8 Case :- WRIT - C No. - 1672 of 2025 Petitioner :- Ram Jiyawan Respondent :- Assistant Collector/Tehsildar (Judicial) Tahsil- Kadipur And Another Counsel for Petitioner :- Jitendra Kumar Pandey,Ankit Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent no. 1 has been accepted by the office of the learned Chief Standing Counsel. Sri Mohan Singh, learned counsel has accepted notice on behalf of respondent no. 2-Gram Sabha. A preliminary objection has been raised by the learned Standing Counsel as well as the learned counsel for the Gaon Sabha that the instant petition is not maintainable, inasmuch as, the petitioner is assailing the order dated 19.01.2024 whereby in proceedings under Section 67 of the U.P. Revenue Code, 2006 and notices have been issued to the petitioner. It is submitted that since the matter is already seized and the petitioner has already filed his objections, accordingly, the instant petition is not maintainable. The learned counsel for the petitioner after arguing at some length could not dispute that the fact there is no explanation as to why the instant petition has been filed after more than a year. He also could not dispute the fact that the extracts of the order sheet which has been brought on record as Annexure No. 6 do not indicate that what has transpired on 09.08.2024 which is the date on which the petitioner has filed his objections. He also could not dispute the facts that the objections are still pending and they have not been decided. Considering the aforesaid facts and circumstances, this Court is not inclined to entertain the present petition which is accordingly dismissed leaving it open for the petitioner to contest and raise his grievances before the Authority concerned and needless to say that in case if the objections are on record, the Authority shall consider and decide the same strictly in accordance with law.
