Applicant- Fardeen, who is in judicial custody in connection with FIR No. 62 of 2024, under Sections 147, 354 452, 323, 307, 504 and 506 IPC, registered at Police Station Kashipur, District Udham Singh Nagar, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant contends that the applicant has falsely been implicated in the case and is languishing in jail since 12.02.2024; the FIR is delay one, as it has been lodged after lapse of five and half hours of the alleged incident; person who lodged the FIR was not eyewitness of the incident. He submitted that the co-accused, namely, Aakib and Rauf have already been granted bail by the Coordinate Bench of this Court and applicant is entitled to be released on bail on the ground of parity. 6. Per contra, learned Deputy Advocate General vehemently opposed the bail on the ground that main role has been assigned to the applicant, therefore, the applicant is not entitled to be released on bail. 7. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that application deserves bail on the ground of parity. 8. Accordingly the bail application is allowed. 9. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
