Court No. - 15 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 224 of 2025 Applicant :- Raziuddin @ Riyazuddin And Another Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Manoj Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicants, learned AGA for the State and perused the record. The instant anticipatory bail application has been filed on behalf of the applicants with the prayer to release them on anticipatory bail in Case Crime No. 299 of 2021, under sections 419, 420, 467, 468 & 471 of the IPC, Police Station-Huzurpur, District-Bahraich. Contention of learned counsel for the applicants is that the applicants are innocent and have falsely been implicated. He added that there is an apprehension that the police will arrest the applicants as such, they may be enlarged on anticipatory bail. On the other hand, learned counsel appearing for the State has opposed the contentions aforesaid and submits the proceedings under sections 82 & 83 of the Cr.P.C., have been initiated against the applicants and they are not cooperating with the investigation proceedings and as such, submission is that the applicants are not entitled for any relief. Considering the submissions of learned counsel for the parties and after perusal of material placed on record, it transpires that the proceedings under sections 82 & 83 of Cr.P.C. have been initiated against the applicants and they are not cooperating with the investigation proceedings. In view of the aforesaid, this court does not find any good ground to intervene in this matter in view of the law settled by Hon'ble Apex Court in the case of Srikant Upadhyay and Others Vs. State of Bihar and Another, reported in 2024 SCC Online SC 282. Consequently, the anticipatory bail application of the applicants, Raziuddin @ Riyazuddin and Shareef alias Mo.
