Order 24/03/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.76/2025, registered at Police Station Kardhani, District Jaipur (West), for the offence(s) under Sections 8/21 of the N.D.P.S. Act.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the accused-petitioner was not aware about the fact that the other co-accused Kishan Singh Dhakad was transporting the contraband articles in the rented car with him. It is also contended that the car was rented to the other co-accused Kishan Singh Dhakad on 02.11.2023 and the said agreement is part of the charge-sheet. The police has not conducted any investigation as to
[2025:RJ-JP:13224] (2 of 3) [CRLMB-4051/2025] the genuineness of the said document and simply charge-sheeted the accused-petitioner assigning the petitioner as registered owner. There are no criminal antecedents against the accused- petitioner, the accused-petitioner is in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the present petitioner has supplied his vehicle for transporting the contraband articles. It is contended that from the possession of the other co-accused Kishan Singh Dhakad 50.60 grams of smack was recovered, therefore, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. The main allegation of transporting the contraband articles containing 50.60 grams of smack is against the other co-accused Kishan Singh Dhakad, there are no criminal antecedents against the present petitioner and the Investigating Agency has also taken on record the agreement executed between the present petitioner and the co-accused Kishan Singh Dhakad about handing over the vehicle on rent, the further trial of the case may take considerable time, therefore, considering the above facts, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
