The present appeal has been filed against the judgment and order dated 04.08.2010 passed by Additional Sessions Judge, Fast Track, Court No.3, Mainpuri, in Sessions Trial No.25 of 2008. 2. As per the Office report dated 19.05.2025, based on the report of learned Chief Judicial Magistrate, Mainpuri, dated 28.03.2025, according to which, the sole surviving appellant, namely, Tota Ram son of Mathura Prasad died in the year 2017. We have perused the report of the Chief Judicial Magistrate along with the statement of Ramveer Singh nephew of sole appellant Tota Ram and the death certificate issued by Village Pradhan, Geeta Devi. Statements of Sub Inspector, Hemveer Singh, who states that the brother of the deceased Ram Sewak has certified that he died in the year 2017. Statements of Sub Inspector Hemveer Singh and village Pradhan, Geeta Devi, have also been annexed. 3. The appeal, accordingly, stands abated.
