CM-14721-C-2025 This is an applicaon under Secon 5 of the Limitaon Act to condone the delay of 23 days in filing the appeal. Heard. For the reasons as menoned in the applicaon, supported by an affidavit of the appellant, the delay of 23 days in filing the appeal is hereby condoned. The applicaon stands disposed of.
RSA-4005-2025 (O&M) Plainff of the case is before this Court against the concurrent findings of the Courts below.
2. Plainff-appellant has challenged two memos bearing Nos.5486 and 5487 both dated 28.08.2017, whereby demand of assessment charge of 16,46,982/- and compounding amount of 1,10,000/- was made in respect of an electricity connecon. The stand of the defendant was that impugned bill was raised as plainff was found to be commi3ng the4 of electricity. Both the Courts below have dismissed the suit. 3. Recently, a Division Bench of this Court in RSA-4181-2016 tled Mahesh Kumar Vs. Sub Divisional Officer and another and connected ma#ers, decided on 14.05.2025, has held that in such like ma9ers, jurisdicon of the Civil Court is barred.
4. In view of the aforesaid circumstances, the present appeal is hereby dismissed as the suit itself was not maintainable on account of the fact that jurisdicon of the Civil Court was barred. However, liberty is granted to the plainff-appellant to avail the alternave remedy available with him, in accordance with law. November 20, 2025
