The order of blacklisting does not mention about any show cause notice having been given to the petitioner prior to passing of the said order nor does it mention the duration for which the blacklisting has taken place which is also mandatory in view of the judgment of Hon'ble Supreme Court passed in State of Odisha and others vs. Panda Infraproject Limited (2022) 4 SCC 393. On being confronted, Shri Rajesh Tiwari, learned Additional Chief Standing counsel could not dispute the aforesaid fact. In view of the aforesaid, we quash the impugned order of blacklisting dated 15.11.2024, however, with liberty to respondent No.2 to proceed and pass a fresh order in accordance with law i.e. after issuing a show cause notice to the petitioner mentioning the allegations against him along with supporting proof/ material, if any, and then if any reply is submitted, to consider the same and pass a fresh order.
