Heard learned counsel for the revisionist and learned A.G.A. for respondent State. Notices to respondent nos.2,3 and 4 are dispensed with in view of the proposed order. Under challenge is the impugned judgement and order dated 21.1.2025 passed by learned 3rd Additional Principal Judge, Family Court, Lakhimpur Kheri in Case No.532 of 2019 under Section 125 Cr.P.C. Perused the record. Perusal of the record shows that it is not in dispute that respondent no.2 is the legally wedded wife of the revisionist and respondent nos. 3 and 4 are her minor daughters. Respondent nos.2,3 and 4 are destitute and incapable of maintaining themselves. Respondent no.2 is residing away from the revisionist for sufficient cause. She has been subjected to cruelty relating to demand of dowry. The revisionist has adequate source of income and is capable of maintaining the respondents. The revisionist has neglected to maintain his wife and children, as, admittedly, upon a query being put by the court below from the revisionist, he could not show as to whether any amount since 2019 has been paid by him to the respondents. Thus, it appears that no maintenance has been paid to the respondents by the revisionist till date. I find no illegality in the order impugned.
