The present bail application has been moved by the applicant- accused- Pradeep Yadav for the offence punishable under Sections 318(4), 338, 336(3), 340(2), 3(5), 204, 308(2), 351(4) B.N.S. and Section 66(D) of I.T. Act in Case Crime No. 322 of 2024, Police Station- Cyber Crime, District- Ghaziabad. 2. Mr.Abhay Kumar, learned advocate, appears on behalf of applicant and submits that accused-applicant has been falsely implicated in the present case. The amount of Rs. 15 lac has been credited and debited from the account of accused, which has been misused by co-accused Shubham Vashishtha, who has already been enlarged on bail by the coordinate Bench of this Court in the present case. The accused-applicant is milkman, who is having a criminal history of four cases, in all the four cases, the accused- applicant is on bail. 3. Per contra, learned AGA opposed the bail and submits that four cases of criminal history shown against accused-applicant and in all the four cases he has been bailed out. The charge sheet has been submitted. 4. This Court has taken into consideration the rival submissions made by the parties and perused the record. 5. Prima facie, the record reveals that account number of the accused-applicant has been misused by the co-accused. The co- accused -Shubham Vashishthe has already been granted bail by the coordinate Bench of this Court. The accused-applicant is in jail since 15.12.2024. 6. Without touching the merit of the case, this bail application is allowed. 7. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
