1. The petitioner has filed this petition seeking the following reliefs:
“i. This Hon'ble court may kindly be pleased to direct the respondent authorities to consider the case of the petitioner for compassionate appointment. SMT NIRMALA RAO
2 ii. That, this Hon'ble court may kindly be pleased to direct the respondent authorities to release all the death claim amount along the interest i.e. 18% per annum. iii. Any other writ or direction which this Hon'ble court deem fit and proper in the case may also be passed along with the case in the interest of justice.”

Learned counsel for the petitioner would submit that the services of the father of the petitioner were terminated by the respondent authorities on account of unauthorized absence, vide order dated 5.12.1991. A civil suit was filed by the petitioner seeking a declaration of civil death, which was decreed vide judgment and decree dated 4.9.2013. He would submit that the application for grant of dependent employment was moved prior to the issuance of the order of termination i.e. 5.12.1991, and therefore, the respondent authorities ought to have decided the said application.

4. Considering the fact that the services of the father of the petitioner were terminated vide order dated 5.12.1991 and the said order has not been challenged, the claim with regard to dependent employment cannot be considered.
5. Accordingly, this petition fails and is hereby dismissed. However, the petitioner would be at liberty to assail the said termination order before the appropriate forum, if so advised. Sd/-
