03 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Uploaded on 26.12.2025 CJ Court Case No. WP(C) No. 3525/2025 CM No. 8027/2025 UT of J&K and ors. …Petitioner(s)/Appellant(s) Through: Mr. Vishal Bharti, Dy. AG v/s Mohd Rafi and Ors. …Respondent(s) Through: Mr. P. N. Bhat, Advocate CORAM HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE ORDER 23.12.2025 1. Through the instant writ petition, the petitioners have assailed the order dated 24.07.2025 passed by the Central Administrative Tribunal, Jammu (hereinafter referred to as “the Tribunal”) in Contempt Petition No. 165/2025, arising out of T.A. No. 2815/2020, titled, Mohd. Rafi and others v. Mr. Pardeep Kumar (IAS) and others. The impugned order reads as under: “Mr. Sudesh Magotra, learned AAG is directed to seek instructions from the Department as to why the contemptuous order has been passed. Respondents are granted last and final opportunity to comply with the order, failing which the Secretary, Forest Department shall remain present before the Court, otherwise coercive action would be taken.” 2 WP(C) No 3525/2025 2. A perusal of the impugned order reveals that the Tribunal has not passed any final or conclusive order determining the rights or liabilities of the parties. It is well settled that interlocutory directions passed during the pendency of contempt proceedings do not give rise to a cause warranting interference in exercise of writ jurisdiction. 3. In view of the above, the present writ petition is found to be misconceived and is, accordingly, dismissed.
