Heard learned counsel for the revisionist and learned A.G.A. for the State-respondent. In view of the proposed order being passed, notices to respondent Nos.2 and 3 are dispensed with. The present revision has been filed by the revisionist against the judgment and order dated 30.11.2024 passed by Principal judge, Family Court, Ambedkar Nagar in Criminal Misc. Case No.135/2018 "Smt. Shobhawati and another vs. Arun kumar" under Section 125 Cr.PC., P.S. Jahangirganj, District Ambedkarnagar. Perused the record. It is not in dispute that respondent No.2 is the legally wedded wife of the revisionist and respondent No.3 is his minor son. They are destitute and unable to maintain themselves. Respondent No.2 has been subjected to cruelty and is residing away for sufficient cause. On the other hand, revisionist is capable of maintaining himself and is wife and child. The revisionist has denied the maintenance of the respondent. It is also admitted that even the interim maintenance has been given by the revisionist only 3-4 times thus, it is clear that he has neglected to maintain his wife and minor children, there appears to be no illegality in the order impugned.
