Heard learned counsel for the appellants and learned A.G.A. for the State. The present appeal has been filed for setting aside the entire proceedings of S.S.T. No. 1242/2021 (State of U.P. Versus Mohd. Ahmad @ Pappu & others) arising out of impugned charge-sheet No. A-15/2021, dated 14.06.2021 filed by the investigating officer against the applicants/appellants in Case Crime No. 0062/2021, Under Section-147, 148, 323, 504, 506 I.P.C. and Section-3(1) (Da), 3(1) (Dha), 3(2) V-Ka of SC/ST Act pertaining to Police Station-Hathigawan, District-Pratapgarh as well as summoning order dated 22.11.2021 passed by the court of learned Special Judge, SC/ST Act, Pratapgarh. After arguing for sometime, learned counsel for the petitioner submits that he does not want to press this appeal with liberty to move an application for discharge through counsel before the trial court and the same may be decided by the learned trial court in a time bound manner. Accordingly, the appeal is dismissed as not pressed providing that in case, the appellants move an appropriate application for discharge through counsel before the concerned Court below within a period of fifteen days from today, the same shall be considered and decided expeditiously, preferably within a period of two months in accordance with law, by the concerned trial court.
