JUSTICE A. GUNESHWAR SHARMA O R D E R 16-05-2025 [1] Heard Ms. Timmiwon Raihing, learned counsel for the petitioner and Mrs. Ch. Sundari, learned Government Advocate for the State respondents. [2] The petitioner who is an association, All Tribal Disables’ Union Manipur (ATDUM) made a representation dated 29-04-2025 to the Chief Secretary, Government of Manipur for financial assistance for organizing a Disability-Inclusive Event during 5th State Level Shirui Lily Festival, 2025 starting from 20th May, 2025. It is also stated that the petitioner-association also submitted a representation dated 05-05-2025 to the State Commissioner for Persons with Disabilities, Manipur so that direction may be given to the State authority for inclusion of persons with disabilities in the budget allocation for the 5th State Level Shirui Lily Festival 2025. [3] In pursuance to the representation dated 05-05-2025 submitted by the petitioner-association, the State Commissioner for Persons with Disabilities, Manipur requested Secretary (Tourism), Government of Manipur vide letter dated 06-05-2025 for considering the case of the petitioner. Since nothing was done, the petitioner-association approached NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.05.16 17:27:13 +05'30' WP(C) No. 412 of 2025 this Court with a prayer for directing the State respondents for budgetary allocation for inclusion of persons with disabilities in the 5th State Level Shirui Lily Festival, 2025 in accordance with Sections 3, 29 and 30 of the Rights of Persons with Disabilities Act, 2016. [4] During the course of hearing, it is submitted that since Shirui Lily Festival is going to start from 20th May, 2025, the writ petition may be disposed of by directing respondent No. 3, i.e. Director, Tourism Department, Government of Manipur for considering the case of the petitioner for participation of Persons with Disabilities (whether belongs to members of the petitioner or others) and if possible with financial assistance for such participation. [5] Mrs. Ch. Sundari, learned Government Advocate for the State respondents, submits that in view of the urgency and peculiar facts of the case, the writ petition may be disposed of as prayed for by the learned counsel for the petitioner. [6] Recording the submissions made at the Bar and in view of the upcoming 5th State Level Shirui Lily Festival, 2025 starting from 20th May, 2025, the writ petition is disposed of by directing Director, Tourism Department, Government of Manipur to include persons with disabilities (whether belonging to the members of the petitioner or others) in the ensuing 5th State Level Shirui Lily Festival, 2025 and examine extension of financial assistance to such participation.
