(2) Since common questions of fact and law are involved in both writ petitions, these are being heard and decided together by this common judgment. However, for the sake of brevity, facts of Writ Petition (M/S) No. 2915 of 2025 alone are being considered and discussed here. (3) Writ Petition (M/S) No. 2915 of 2025 has been filed by Committee of Management, Janta Junior High School, Jakhnyali, Nailchami, District Tehri Garhwal seeking the following reliefs: “i. Issue a writ, order or direction in the nature of mandamus directing the Respondent No. 05 to give permission for advertisement of vacant posts of Assistant Teachers (General) and Assistant Teacher (Science/Maths) in Janta Junior High School, Nakhnyali, Nailchami, District Tehri Garhwal. ii. Issue a writ, order or direction in the nature of mandamus directing the Respondent No. 05 to constitute a panel of experts for recruitment/interview process for vacant posts of Assistant Teachers (General) and Assistant Teacher (Science/Mathematics) in Janta Junior High School, Nakhnyali, Nailchami, District Tehri Garhwal.” (4) It is the contention of petitioner 2025:UHC:9223 that there are two vacancies on the post of Assistant Teacher in the concerned school and request was made to the District Education Officer (Elementary) to grant permission for advertising those vacancies, but permission has not been granted so far. Application for permission was allegedly made on 6.9.2025. Petitioner refers to a judgment dated 3.9.2025, passed by this Court in Writ Petition (M/S) No. 2839 of 2023. (5) Having regard to the facts and circumstances of the case, writ petition is disposed of with a direction to District Education Officer (Elementary), Tehri to consider petitioners’ application and pass appropriate order, as per law, within three weeks from the date of presentation of certified copy of this order.
