Neutral Citation No. - 2025:AHC-LKO:10414 Court No. - 7 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 1509 of 2025 Applicant :- Sudha Devi @ Surta Devi Opposite Party :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko Counsel for Applicant :- Anand Kumar Srivastava Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
2. This is the second bail application. The first bail application was rejected by this Court vide order dated 05.07.2024. 3.The counsel for the applicant argues that the applicant is a lady of unsound mind, which is stated by the Doctor in his statement recorded on
20.11.2024. He further argues that the application is languishing in jail since 08.04.2024 having no criminal history, as such, she may be enlarged on bail.
4. Learned A.G.A. opposed the bail prayer.
5. Considering the fact that the applicant is a lady of unsound mind and is aged about 65 years and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial and without expressing any opinion on merit, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed.
6. Let the applicant Sudha Devi @ Surta Devi be released on bail in FIR/ Case Crime No. 09 of 2024, under Sections 498-A, 302 IPC and Section
3/4 Dowry Prohibition Act, Police Station Kotwali Nagar, District Balrampur, on her furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence.
