Under challenge is the order dated 14.07.2021 passed by the Director, Education (Secondary), Government of U.P., a copy of which is Annexure-1 to the petition, whereby claim of the petitioner in pursuance of the direction issued by this court vide order dated 09.04.2019 passed in Writ Petition No.10659(SS) of 2016 In Re Dhruvesh Tripathi vs State of U.P. & Ors, a copy of which is Annexure-6 to the petition, for considering the claim of the petitioner as to whether the petitioner can be treated as Sanskrit Teacher, has been rejected. 3. A perusal of the impugned order would indicate that the respondents have considered the claim of the petitioner against the post of Assistant Teacher (Modern Subject). 4. Admittedly, Sanskrit does not fall within the ambit of being Modern Subject. 5. Thus, it is apparent that the respondents have failed to consider the claim of the petitioner in terms of the direction of writ court. 6. Considering the aforesaid, order dated 14.07.2021, a copy of which is Annexure-1 to the petition, is set aside. 7. The writ petition is partly allowed. The matter is remitted to the Director, Education (Secondary), Government of U.P. i.e. respondent No.2 to pass a fresh order in the light of the judgment of this court dated 09.04.2019. 8. Let the order be passed within a period of six weeks from the date of receipt of a certified copy of this order.
