Neutral Citation No. - 2025:AHC-LKO:10404-DB Court No. - 2 Case :- WRIT - C No. - 1501 of 2025 Petitioner :- Alauddin Khan Respondent :- State Of U.P. Thru. Its Prin. Secy. Energy Deptt. Lko. And 3 Others Counsel for Petitioner :- Rakesh Kumar Singh Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard.
2. Petitioner has sought a writ of mandamus to the opposite parties for restoring the electricity connection which was disconnected on 23.12.2024 and also that they should calculate the undisputed amount as per the meter reading which the petitioner is ready to pay in easy installments.
3. Learned counsel for the petitioner refers to certain orders of consumer forum etc relating to theft of electricity. However, learned Standing Counsel for electricity corporation says that electricity connection was disconnected not account of the said episode but on account of electricity dues w.e.f. 2006 which are now to the tune of Rs.6,27,959/- and a bill has been generated in this regard on 20.12.2024. This bill has not been disputed or challenged by the petitioner, therefore, electricity connection cannot be restored.
4. On being confronted, learned counsel for the petitioner could only advance an emotional argument that consequent to disconnection of electricity connection, the petitioner is residing in the dark. Well, we can only say that if it is so the petitioner has to thank himself for this predicament. Without any challenge to the electricity bill before the appropriate forum, this petition is not maintainable.
5. Accordingly, the petition is disposed of with liberty to pursue such other remedies as may be permissible in law. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 18.2.2025/Shanu/- Digitally signed by :- SHANU SUMAN High Court of Judicature at Allahabad, Lucknow Bench
