Neutral Citation No. - 2025:AHC-LKO:37988 Court No. - 18 Case :- WRIT - A No. - 979 of 1995 Petitioner :- Shiv Kumar Tewari Respondent :- State of U.P. and Others Counsel for Petitioner :- Sampurnanand,Manjeet Singh,Sampurna Nand Shukla Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.
2. Petition has been filed seeking a direction to opposite parties to continue petitioner on the post of Collection Amin and for payment of salary.
3. It is quite evident from the pleadings that petitioner even at the time of filing of petition was 28 years old and would be near superannuation by now. There does not appear to be any interim
order in favour of petitioner whereby he was continuing on the post of Collection Amin. Such a fact has also admitted by Mr. Manjeet Singh, learned counsel for petitioner.
4. He, however, submits that subsequently petitioner's representation was rejected in the year 1995 and seeks liberty to amend the petition to challenge the said order.
5. It is quite evident that even if petitioner's representation was rejected in the year 1995, 30 years have passed without any effort on behalf of petitioner to effect any such amendment.
6. In view thereof, the prayer so made is rejected.
7. The petition is, therefore, dismissed as having been rendered infructuous.
